Prohibition on Use of Reputation Risk by Regulators Notice of proposed rulemaking Summary: The FDIC and the Office of the Comptroller of the Currency propose to codify the elimination of reputation risk from their supervisory programs. The proposal would prohibit the agencies from criticizing or taking adverse action against banks on the basis of reputation risk. It would also prohibit the agencies from requiring, instructing, or encouraging banks to close an account, to refrain from providing an account, product, or service, or to modify or terminate any product or service on the basis of political, social, cultural, or religious views or beliefs, protected speech, or politically disfavored but lawful business activities. Adjusting and Indexing Certain Regulatory Thresholds Proposed Rule Summary: The Federal Deposit Insurance Corporation (FDIC) proposes to amend certain thresholds in the FDIC’s regulations to reflect inflation. The proposal would generally update such thresholds to reflect inflation from the date of implementation or the most recent adjustment and provide a methodology for future adjustments. The proposed changes would provide a more durable regulatory framework by preserving, in real terms, the level of certain thresholds in the FDIC’s regulations, thereby avoiding an outcome where the applicability of a regulatory requirement changes due solely to inflation rather than actual changes in an institution’s size, risk profile, or level of complexity. Establishment and Relocation of Branches and Offices Proposed rule Summary: The FDIC proposes to modify the procedures for an insured State nonmember bank to establish a domestic branch or relocate a domestic main office or branch. The proposed rule would eliminate certain filing requirements, shorten processing timelines, and eliminate public notice procedures.
